Claim struck out after wrong Court fee paid

In a recent County Court decision, a claim was struck out and the Claimant was no longer allowed to proceed with her case, because the wrong fee had been paid when the claim was issued.
Now that Court fees for issuing a claim are expressed as a percentage of the value of the claim, for claims over £10,000, there may be a temptation to under value a claim, so that a lower issue fee can be paid.
However, this decision by the County Court demonstrates that the risks of taking this approach can be very high.
